Unusual Order: The Constitutional Imperative to Separate the Office of President from Commander-in-Chief

Executive Summary

This paper presents findings from the Governance, Ethics & Operational Governance (GEOG) framework on a critical flaw in contemporary constitutional design: the fusion of the Office of President with that of Commander-in-Chief (C-in-C). Our research concludes that the line of ethical degradation in security forces persists regardless of whether the C-in-C is civilian or military. The fear that a military C-in-C precipitates coups has been rendered obsolete by codified constitutional governance. The true safeguard is not the background of the officeholder, but the structural separation of powers and direct operational funding mechanisms.

Core Thesis: The ethics that govern the Forces Profession in any nation is to uphold the full faith of the Constitution. The Forces have one core duty: the GOOD of the Citizens and the Constitutional uphold above all exciting aspects of Government, including the Citizens themselves in situations where there are no amendments to that part or any part of the Constitution.

1. Situation Analysis: The Command Climate Problem

Recent discourse confirms a systemic loop: When the highest command line harbors corrupt practice, the ethics of all Law Enforcement Agencies are marginalized throughout the system. If the top hides certain corrupt practices, the local level adopts the same mindset. This is not a question of military versus civilian leadership, but of institutional incentives.

During military rule, decrees overrode the constitution. In civilian rule, a strict system of governance governed by the constitution exists, with each aspect of Government having laid down rules clearly spelt out and updated via constitutional amendments. The C-in-C will not go out of its ethics of guidance which is the clearly spelt out rules in the constitution to his own framework.

"If the Police can allow a crime from a suspect which happened in their presence to slip under the carpet due to financial gain from the suspect or lack of adequate funds from the petitioner, then you already understand that the problem is from the top, which is right from the highest Command line which is the C-in-C."

2. Key Research Findings

Finding I: The Fusion Fallacy

The same line of flow can still happen whether the Grand Commander-in-Chief (GCIC) is a civilian or military. The office of President is a name of an office as is C-in-C. The C-in-C is a commanding line for a call, not a personality. Therefore, the debate should not be "civilian vs military" but "fused office vs separated office."

Finding II: Obsolete Fear of Military Takeover

The fear that a military GCIC will have the military taking over is long eradicated through the system of Governance clearly spelt out in the constitution. Modern constitutions, including Nigeria's 1999 Constitution, contain explicit provisions for civilian oversight, tenure limits, appropriation powers, and the duty to disobey manifestly illegal orders that make coups structurally difficult.

Finding III: The Constitutional Ethic

The Forces Profession is bound by one supreme ethic: uphold the full faith of the Constitution. The core duty is the GOOD of the Citizens and the Constitutional uphold above all exciting aspects of the Governments. This duty supersedes even the citizens themselves where there are no constitutional amendments. The military does not define national values; it defends the values defined by the constitution.

3. The GEOG Solution: Bank of God Framework

To eradicate the funding loop that corrupts the system, GEOG proposes direct operational resourcing for Armed Forces Personnel through the Bank of God framework.

3.1 Principles of Operation

  • Direct-to-Personnel Funding: Armed Forces Personnel receive funding on the go for any public or personal services. They need no funds from anyone to do their job effectively.
  • Removal of Financial Excuse: This strategy eradicates the loop that funds its way into corrupting the system. No officer can claim "no fuel for patrol" or "no money for case file."
  • Ethics Enforcement by Design: Funds are released based on lawful orders, verified by bodycam/GPS data. Illegal roadblocks or personal errands trigger automatic wallet freeze.

3.2 Constitutional Alignment

This framework operates within Section 14(2)(b) of the 1999 Constitution: "the security and welfare of the people shall be the primary purpose of government." It also reinforces Section 217(2) which defines the Armed Forces' role as defence of Nigeria and maintenance of territorial integrity, not personal service to officeholders.

Unusual Order to the Global Public: It is inexhaustibly important to separate the office of the President and Grand Commander-in-Chief. The C-in-C must be a professional office, bound by the constitution and resourced by GEOG, not a political appendage. This separation ensures the Forces uphold the Constitution, not the personality in power.

4. Conclusion & Global Recommendation

The effectiveness of governance is rearranged into its perfect order when operational ethics are funded directly and command is separated from politics. The Royal Defense Academy therefore recommends:

  1. Constitutional amendment to separate the offices of President and Commander-in-Chief.
  2. Adoption of the GEOG Bank of God framework for direct-to-personnel operational funding.
  3. Establishment of an independent audit trail for all security operations, accessible to the public.

When the system is right from the top, the untactful acts that yield many throughout the administration cease. The GOOD of the Citizens becomes the only order.
